Man accused of using Facebook to kidnap, kill young girl is not a murderer, lawyer says

Police say he wanted to kidnap the girl and then later rescue her to be given credit as the hero, but it went wrong and she died of asphyxiation.

A young man in Maine accused of attempting a botched kidnapping that resulted in the death of a 15-year-old girl is “not a killer,” his lawyer is arguing.

Defense attorney Wendy Hatch, who is defending 21-year-old Kyle Dube against charges of kidnapping and murder in the 2013 death of high school sophomore Nichole Cable, according to an Associated Press report.

Opening statements began today in the trial, where Dube stands accused of attempting to abduct Nichole while masked and then come back later as her rescuer to be hailed as a hero. The abduction went wrong and Nichole died of asphyxiation, according to prosecutors.

However, his attorney is arguing that it wasn’t him at all that committed the crime, and that there are major holes in the state’s case against him. Dube “got up the next morning, got dressed, kissed his daughter goodbye” and went ahead with his day as normal, she argued according to the report.

Prosecutors say they have a lot of evidence linking Dube to the death, as a fake Facebook account was traced to his home and DNA on a hat at the end of the driveway prove that he was near the teen’s home. Prosecutors also say they have cell tower records that further establish that he was in the area. Additional DNA can also be found on the girl’s fingernails, they allege.

The witness list in the trial is expected to have more than 80 names. One of those witnesses is a man who had no involvement of the abduction, but the fake Facebook page was created in his name to throw people off the trail, according to authorities.
